Novare Legal Strategist inc. (“Novare”, “we”, “us”, “our”) attaches great importance to protecting the personal information entrusted to it. In connection with its legal services, training activities, professional communications and business administration, Novare may collect, use, disclose, retain or destroy certain personal information, always with diligence, discretion and in compliance with applicable laws.
This policy is intended to explain, clearly and transparently, Novare’s practices regarding the protection of personal information, including the types of information collected, the purposes for which it is used, the persons with whom it may be shared, the protection measures implemented and the rights of the individuals concerned.
For the purposes of this policy, personal information means any information relating to a natural person that directly or indirectly allows that person to be identified. Certain professional information, such as a person’s name, title, duties, address, email address or work telephone number, may, however, be public in certain circumstances.
Who we are
Novare is a Quebec law firm specializing in particular in labour and employment law, occupational health and safety and workers’ compensation, labour relations, human resources and regulatory compliance. Novare primarily supports employers, managers and organizations in preventing, managing and resolving workplace-related situations.
For the purposes of this policy, Novare is responsible for protecting the personal information it holds. Catherine Deslauriers, lawyer and President of Novare, acts as the person responsible for the protection of personal information, including for handling requests relating to personal information and confidentiality incidents.
What personal information do we collect?
The personal information collected by Novare varies depending on the nature of the relationship with the individual concerned and the services requested. It may include, in particular:
- identification information, such as last name, first name, title or position;
- contact information, such as mailing address, email address and telephone number;
- professional information, such as the employer’s name, position held, organizational context or professional responsibilities;
- information necessary to provide legal services, including information related to a mandate, file, claim, workplace situation, dispute or consultation;
- information relating to training sessions, events, registrations, communication preferences or information requests;
- billing and payment information, including, where required for registration or payment for training or a service, information relating to a personal or corporate credit card;
- information provided as part of a recruitment, professional collaboration or service delivery process;
- technical information related to the use of the website or digital tools, including through cookies, where used;
- any other personal information voluntarily provided to Novare in connection with a communication, mandate or professional relationship.
In certain files, Novare may have access to sensitive information, including medical, financial, disciplinary, family-related or employment-related information. This information is handled with increased caution and only where necessary for the purposes of the mandate or applicable obligations.
How we collect personal information
Novare generally collects personal information directly from the individual concerned, their representatives, agents or the organization retaining its services. Information may be transmitted, in particular, by email, telephone, web form, virtual meeting, in-person meeting, shared documents or technological tools used in connection with the services.
Novare may also collect information from public sources or documents accessible in connection with a mandate, where relevant and compliant with applicable laws.
For what purposes do we use personal information?
Novare uses personal information only for the purposes for which it was collected, or for purposes compatible with those purposes, including to:
- provide legal, strategic, training or support services;
- open, administer, analyze, document and manage files or mandates;
- communicate with clients, participants, partners, suppliers or other individuals concerned;
- respond to information, registration, follow-up or service requests;
- prepare documents, notices, contracts, policies, training materials, opinions or representations;
- comply with applicable professional, legal, ethical, tax, accounting or regulatory obligations;
- process invoicing, payments, reimbursements, account follow-up and Novare’s internal administration;
- process registrations, payments, reimbursements or administrative follow-ups related to Novare’s training and other services;
- send professional communications, invitations, news, legal content or information about services, where permitted by law;
- improve Novare’s services, tools, content and communications;
- protect the rights, interests, security and confidentiality of Novare, its clients or third parties.
With whom do we share personal information?
Novare does not sell personal information. However, it may disclose personal information, where necessary, to the following persons or organizations:
- authorized persons within Novare or its collaborators, where access is necessary for the performance of their duties or the handling of a mandate;
- clients, representatives, experts, consultants, corresponding lawyers, suppliers or partners involved in a mandate or service;
- technology, administrative, accounting, cloud, secure payment, communication or hosting service providers used by Novare;
- courts, administrative bodies, government authorities, professional orders or regulatory bodies, where required or permitted by law;
- any other person or organization where the individual concerned consents or where authorized by law.
When Novare uses service providers, it limits the information disclosed to what is reasonably necessary and seeks to ensure that those providers protect the information in accordance with applicable requirements.
When payment is made by credit card, the information necessary to process the payment may be transmitted to a secure payment service provider. Novare retains this information only to the extent necessary for payment, invoicing, reimbursement or its legal and accounting obligations.
Where is personal information stored?
Personal information held by Novare is stored in Canada.
How long do we retain personal information?
Novare retains personal information only for as long as necessary to fulfill the purposes for which it was collected, subject to applicable legal, professional, tax, accounting, ethical or regulatory obligations. When the information is no longer required, Novare takes reasonable measures to securely destroy, delete or anonymize it, depending on the context.
How do we protect personal information?
Novare implements reasonable security measures adapted to the sensitivity of the information it holds in order to protect it against loss, theft, unauthorized access, unauthorized use, unauthorized disclosure, modification or destruction. These measures may be administrative, contractual, physical or technological in nature.
Access to personal information is limited to persons who need to access it in the performance of their duties or for the completion of a mandate. Despite these measures, no method of electronic transmission or storage is entirely risk-free. Any person who believes that personal information has been compromised is encouraged to promptly contact the person responsible for the protection of personal information at Novare.
Financial information, including information related to a personal or corporate credit card, is handled with particular care and only for the purposes necessary to process the payment or authorized related follow-ups.
Confidentiality incidents
A confidentiality incident may include unauthorized access to personal information, its unauthorized use, unauthorized disclosure, loss or any other breach of its protection. Catherine Deslauriers is the person designated by Novare to receive, analyze and handle confidentiality incidents involving personal information.
When an incident occurs, Novare takes reasonable measures to limit its consequences, assess the risk of serious injury, record the incident in the appropriate register and, where required by law, notify the individuals concerned as well as the Commission d’accès à l’information du Québec.
Your rights regarding your personal information
Subject to the limits provided by law, any individual concerned may request:
- to know whether Novare holds personal information about them;
- to access the personal information held by Novare;
- to have inaccurate, incomplete or ambiguous personal information corrected;
- to withdraw consent to certain uses or disclosures, where consent is the applicable basis;
- to request that the dissemination of certain information cease, or that certain information be de-indexed or re-indexed, where the conditions provided by law are met;
- in certain cases, to request the communication of computerized information in a structured and commonly used technological format.
A request may be denied, in whole or in part, where permitted or required by law, including to protect professional secrecy, the rights of a third party, the confidentiality of a file or Novare’s professional obligations.
However, refusing to provide certain personal information, or withdrawing consent where consent is required, may limit Novare’s ability to provide certain services, process a registration, respond to a request or continue a mandate.
Electronic communications and unsubscribe
Novare may send electronic communications, including invitations, news, legal content, information about its services or registration confirmations, where permitted by law. Any person may unsubscribe from promotional or non-essential communications by using the mechanism provided for that purpose or by contacting Novare.
Cookies and similar technologies
Novare’s website may use cookies or similar technologies to ensure its proper functioning, improve the browsing experience, measure traffic or better understand how the site is used. Information transmitted before the establishment of a lawyer-client relationship
Transmitting information to Novare, including by email, web form or telephone, does not automatically create a lawyer-client relationship. Such a relationship is established only when Novare expressly confirms that it accepts a mandate. It is therefore recommended not to transmit confidential or sensitive information before this confirmation, unless necessary for the preliminary analysis of the request.
